Welcome to the general conditions of sale applicable to our relationship.

UCM Canada, the owner of this website ucm.center and the owner and operator of UCM products and merchandise, is referred to herein as UCM.

UCM is therefore the seller and the customer is referred to as the buyer or consumer.

UCM puts its skills and seriousness at the service of its customers, in order to satisfy their expectations.
For this purpose it is agreed to strictly observe the following usual commercial rules, which are hereby recognized as a preliminary agreement to any exchange.

Article 1 - Purpose and Generalities

The present general conditions define the rights and obligations of both parties (seller, buyer), applied without restriction or reserve to all sales of products offered through the online merchant site www.ucm.center. To validate an order implies for any person the full acceptance of the present general conditions of sale. The consumer recognizes to be perfectly informed of the fact that his agreement concerning the contents of the present general conditions does not require the handwritten signature of this document, insofar as the customer wishes to order on line the products presented. The consumer has the option to save or edit these general conditions, being specified that both the knowledge, consultation and conservation of this document are his sole responsibility. The consumer keeps at his expense the telecommunication expenses during the access to Internet and the use of the site, as well as the possible expenses of contact for any later complaint.

Article 2 - General presentation of the products

The products offered for sale on the site are available while stocks last. The visual, the labeling and the packaging of the products can evolve and differ appreciably from the display on the site, without interfering on the product itself in its content. Furthermore, the customer always has the possibility of obtaining additional information by electronic mail (e-mail) to the following e-mail address: info@ucm.center. UCM reserves the right to withdraw, replace, modify or change without prior notice the products presented, or if necessary to propose new products, without however modifying the specifications of the products already ordered by the customers.

Article 3 - Use of products

The choice and purchase of a product are the sole responsibility of the customer. UCM declines any abusive use of the products offered that does not conform to their primary purpose.

In any case, UCM cannot be held responsible for non-compliance with the provisions of the the country of reception, the responsibility of the seller is systematically limited to the value of the product value at its date of sale and this without any possibility of recourse to the brand or the company producing the product. 

In the case of In the exceptional case of a proven defect or fault in the goods, UCM undertakes to replace or reimburse the goods at their initial sale value defective, according to the customer's choice, excluding all other procedures.

 Article 4 - Entry into force

The present general conditions come into force and apply without reserve, on the date of validation of the order, specified on the invoice sent to the buyer, who undertakes to respect them in full.

Article 5 - Proof of transaction - Order taking - Archiving

If you wish to purchase one or more items listed on the website, you must select each product you wish to purchase and add it to your cart. When you have selected all the items you want to buy, you can confirm the contents of your cart and place your order.

At this stage, you will be redirected to a page summarizing the details of the products you have selected, their prices and the delivery options (with the relevant delivery charges). You will then be asked to choose the delivery options as well as the shipping and payment methods that suit you best.

The computerized registers, preserved in the computer systems of the commercial site ucm.center in reasonable conditions of safety, will be regarded as the proofs of communication, orders and payments occurred between the parts. The filing of the purchase orders and the invoices is carried out on a reliable and durable support and will be produced as proof.

Any order placed with UCM will be automatically confirmed by electronic mail (e-mail) including the details of the order and the method of payment.

Any validation of the basket including the price of the goods, the delivery costs and the method of payment on the website www.ucm.center is considered as an order confirmation. In accordance with the provisions of the applicable regulations on the conclusion of online contracts, the contract will be concluded when you click on the button allowing you to confirm your order after having viewed the details of it and in particular its total price and having had the opportunity to correct any errors.

The contracts concluded on our website (data relating to your order in accordance with the GTC in force on the day of your order) are archived for a period of 10 years. You can access the archived contracts by sending a request by e-mail to info@ucm.center or by post to :

Article 6 - Prices and Taxes

EURO ZONE/SWITZERLAND

The prices are indicated in Euro/CHF TTC (all taxes included) and are valid only at the date of the validation of the order by the consumer, making mention of his order. They take into account the costs of V.A.T. (Value Added Tax) on the day of the order and any change in the applicable rate of V.A.T. will automatically be reflected in the price of the products. Switzerland is managed and administered by Association UCM Switzerland and all member countries of the European Union and the rest of Europe by Association UCM France.

ZONE CANADA

The prices are indicated in Canadian dollars excluding taxes, and are valid only on the date of the validation of the order by the consumer, mentioning his order. The applicable taxes according to the province (GST+QST for Quebec, GST for the other provinces) will be displayed at the time of the confirmation of the order, and any change in the rate applicable to the various taxes will be automatically reflected in the price of the products. Shipping and delivery costs are not included in the price of the products, except for special promotions for certain countries (Canada and Switzerland). The VAT is not applicable for countries outside the European Community and Switzerland, except on the amount of shipping costs.

US ZONE AND REST OF THE WORLD

The prices are indicated in American dollars (USD) and are valid only on the date of the validation of the order by the consumer, making mention of his order. Shipping and delivery costs are not included in the price of the products. No tax is applicable for purchases made and delivered in countries outside the European Community, Switzerland and Canada, except on the amount of shipping costs, subject to the reservation indicated below.

Please note that deliveries to countries outside the European Union, Switzerland or Canada may also be subject to various fees, taxes, duties and obligations, including customs and import taxes applicable to the country. These costs are borne exclusively by the buyer. The payment of the totality of the price must be made at the time of the order, and becomes due by UCM as soon as the order is validated. The sums paid shall not be considered as deposits or advance payments. The confirmation of agreement to the payment of the order by the client implies that the latter agrees to pay the related delivery charges, if any, and as mentioned at the last stage of the order, as an integral part thereof. UCM reserves the right to change all or part of its prices without prior notice, and all orders placed after the price change will be charged the new prices.

Article 7 - Method of payment

The consumer guarantees that he/she has the necessary authorizations to use the method of payment that he/she has chosen when confirming the order form. UCM reserves the right to suspend any order management and any delivery in the event of refusal of authorization of payment or in the event of nonpayment; in particular the right to refuse to carry out a delivery or to honor an order emanating from a consumer who would not have regulated totally or partially a preceding order or with which a litigation of payment would be in the course of administration.

In the event of non-payment, in particular because of the refusal of the bank to honour the transaction or because of a stop payment made by the client on the transaction, and this, before or after the conclusion of the transaction, UCM may terminate the sale as of right without notice or delay and may, if necessary, demand the return of the product at the expense of the client. Penalties of an amount equal to the legal interest rate increased by ten points are automatically applicable to the amounts unpaid at the end of a period of ten days following the date of invoicing or upon notification of the rejection of bank payment for any other means of payment.

AArticle 8 - Availability of products

Product offers are subject to availability of stock at our various warehouses around the world. For products that are out of stock, offers will be maintained subject to availability from UCM's suppliers. In the case of exceptional and punctual unavailability of a product after the order has been placed, UCM will inform the customers by e-mail or by mail as soon as possible. Customers will then be able to request the cancellation or exchange of the order. In accordance with the regulations currently in force in the present contractual conditions, UCM will be able in this case to provide a product of an equivalent quality and price. The shipping costs will then be borne by UCM. Should UCM fail to make use of this option, the purchaser will be reimbursed without delay and at the latest within thirty days of payment of the sums paid by him/her, except in the case of special arrangements subject to the agreement of the purchaser, such as the transformation of the amount of the order into a purchase voucher or to be used on the next order.

Article 9 - Billing

After validation of the order, a written confirmation will be issued and automatically transmitted by electronic mail (e-mail) to the buyer, except in case of payment by check. The final and detailed invoice of the transaction will be attached in all cases in hard copy with the product(s) ordered in the corresponding package.

Article 10 - Delivery

The delivery of the parcels is carried out by La Poste, in SoColissimo solution, or in Express mode in paying option Chronopost, within the times envisaged by these modes of sending. To this end, the customer undertakes to provide accurate postal information to which he/she can have access. UCM France shall not be held responsible for any problem of delivery, loss or damage due to an error in address, or due to the responsibility of the post office or any other postal or courier service. The UCM association cannot be held responsible for the delivery of parcels by the postal delivery agent, to a person other than the named recipient mentioned on the shipment. In case of return of goods by the post office or by any other postal or courier service, due to non withdrawal by the customer within the time limit, the cost of re-shipment shall be borne by the customer. Upon receipt of a shipment, the customer must verify the good condition of the goods received and, if necessary, make the usual reservations with the postal delivery service. No claim will be taken into account after acceptance of the goods without prior reservation by the customer with the carrier. UCM France undertakes to reduce as much as possible the time between the order and the delivery. In periods of high traffic on the site, this delay should not exceed 30 days for metropolitan France, the customer could then cancel his order and UCM would proceed to his full refund.

Our shipments are made with all the necessary attention and care, but in the case of goods that do not conform to the order form and/or in the case of an error in the preparation of the parcel, UCM France undertakes, upon prior agreement, to take charge of the return of the goods concerned in their intact state and upon receipt of the appropriate goods corresponding to the customer's order.

For delivery in Switzerland, Europe, Canada, United States and the rest of the world, the terms and conditions remain the same, only the postal services change depending on the states. We select the best possible services in terms of speed and shipping costs to give you the best possible experience, such as UPS, Canada Post, etc.

Article 11 - Guarantees

The customers subjected to the regulation of the European Union, profit from the legal guarantee of conformity under the conditions of the articles of the European Directive 1999/44 transposed in France, in the article L.211-4 and following ones of the code of the consumption and the guarantee of the latent defects under the conditions envisaged in articles 1641 and following ones
of the civil code.

In the context of an after-sales service procedure (provided by UCM), any return of goods that are incomplete or not in their original packaging will not be accepted. Any return of the product under the aforementioned guarantee must be subject to prior agreement by UCM by electronic mail (e-mail). To this end, the purchaser shall contact the after-sales service by letter or by electronic mail (e-mail) to: info@ucm.center No return will be accepted without prior authorization from UCM. If applicable, the defective product must be returned in its original packaging, including the entire product and its accessories. All costs and risks associated with the return of the product are the responsibility of the customer. The product under warranty will be exchanged while stocks last. If the product is unavailable, UCM will automatically refund the product within 30 days from the date of receipt of the defective product. In addition, the product must not have been abused, overused, or used in a manner inconsistent with its intended use, and in general, the product must be in its original condition. UCM reserves the right to determine in good faith whether all of these conditions are met. Subject to the provisions of law, Seller's liability is strictly limited to the obligations set forth in these terms and conditions. In the event of bankruptcy or impossibility of supply by our suppliers, the purchaser shall have no claim against the seller.

Article 12 - Withdrawal-Cancellation

In accordance with the regulations currently in force in these conditions, the buyer has a withdrawal period of 14 days from the delivery of his order. Effects: Upon receipt of the returned goods from the customer, if all the conditions of withdrawal are met by the latter, UCM will proceed to the full refund of the order within 14 days at the latest. In any case, this refund will not cause any additional costs for you.

Exceptions to the right of withdrawal:

The right of withdrawal does not apply to :

  • the delivery of products that cannot be returned for reasons of hygiene or health protection, if you have unsealed them or if they have been inseparably mixed with other articles after delivery.
  • The supply of products likely to deteriorate or expire quickly.

Article 14 - Responsibilities

UCM shall not be held responsible for the non-execution of the contract concluded in case of unforeseeable unavailability of the product, force majeure, disruption or total or partial strike, in particular of the postal services and means of transport and/or communications, flooding, fire.

Article 15 - Transfer of ownership

The transfer of property of the products to the benefit of the purchaser, will be carried out only after complete payment of the price by this last, and this whatever the date of delivery of the aforementioned products.
On the other hand, the transfer of the risks of loss and deterioration of the products will be carried out as of reception of the aforementioned products by the purchaser. The present conditions can be modified at any time without notice, the modifications being then applicable to all subsequent orders.

Article 16 - Resolutive and Penal Clause

In the event of non-compliance with one of the obligations of the consumer by the latter, the sale will be terminated by right and the goods will be returned to the seller if he sees fit, without prejudice to any damages that the seller could claim against the buyer, within 48 hours after the formal notice remained without
effect. In this case, the seller is entitled to claim from the buyer a lump sum compensation of 10 % of the sale amount.

Article 17 - Non-waiver

The fact that one of the parties does not avail itself of a breach by the other party of any of the obligations referred to in these terms and conditions shall not be construed for the future as a waiver of the obligation in question.

Article 18 - Force majeure

Neither party shall have failed to perform its contractual obligations to the extent that their performance is delayed, hindered or prevented by an act of force majeure. Will be considered as fortuitous event or force majeure all facts or circumstances irresistible, external to the parties, unforeseeable, unavoidable, independent of the will of the parties and which could not be prevented by these last ones, in spite of all the efforts reasonably possible. The party affected by such circumstances shall notify the other within ten working days of the date on which it becomes aware of such circumstances. The two parties will then meet, within one month, unless impossible due to force majeure, to examine the impact of the event and agree on the conditions under which the performance of the contract will be continued. If the case of force majeure lasts for more than three months, the present general conditions may be terminated by the injured party. Expressly, are considered as force majeure or fortuitous events, in addition to those usually retained by the jurisprudence: the blocking of means of transport or supplies, earthquakes, fires, storms, floods, lightning; the stoppage of telecommunication networks or difficulties specific to telecommunication networks external to the customers.

Article 19 - Severability

If one or more stipulations of the present general conditions of sale are held to be invalid or declared as such in application of a law, a regulation or following a final decision of a competent jurisdiction, the other stipulations will keep all their force and their range.

Article 20 - Jurisdiction clause

The present contractual conditions are subject to French law for contracts concluded with a customer residing in France or to the regulations of the member country of the European Union for the customer residing in one of these countries and finally, to the application of the Vienna Convention "on contracts for the international sale of goods" for the customer residing in another country than the European Union.

In case of
of litigation arising from a sale, both in terms of its interpretation and its execution and possibly after a search for an amicable solution:

For customers residing in France or in a country of the European Union, you, as well as we, agree to submit all disputes arising from the commercial relationship between you and us to the non-exclusive jurisdiction of the courts of France, which means that for the application of these Terms of Sale, you may bring an action to enforce your rights as a consumer, in France or in the country of the European Union in which you reside

For customers residing in other countries, you and we agree to submit all disputes arising out of the business relationship between you and us to the exclusive jurisdiction of the courts of Montreal, Quebec, Canada.

Article 21 - Language

The languages used for the conclusion and the commitments of a contract is :

En m’inscrivant (ci-après “ÉTUDIANT”) à l’une des formations (IRSS, 3MR, DreamerOne) du Centre d’Enseignement et de Recherche UCM (ci-après “UCM”), je comprends et accepte que :

  • UCM s’engage au mieux de ses possibilités et compétences d’assurer et garantir la confidentialité des rêves et informations transmises par l’ÉTUDIANT.
  • UCM s’engage à protéger les informations personnelles de l’ÉTUDIANT. UCM utilise des mesures de sécurité pour protéger les données de l’ÉTUDIANT contre tout accès, utilisation ou divulgation non autorisés.
  • La prestation des formations de UCM ne remplace, en aucun cas, un traitement et un suivi médical, que ces derniers sont de l’entière responsabilité et de la décision unique de l’ÉTUDIANT; peu importe le conseil reçu dans le cadre de sa formation avec UCM.
  • L’ÉTUDIANT est libre d’appliquer ou ne pas appliquer les conseils reçus à travers sa formation donnée par UCM.
  • Un problème de santé physique ou psychologique important de l’ÉTUDIANT peut entraîner l’arrêt définitif ou temporaire, de sa formation, ce pour la sécurité et le bien-être de l’ÉTUDIANT, sous toute réserve de UCM.
  • UCM décline toute responsabilité, d’une part, quant au suivi ou non suivi des recommandations effectuées par le biais de ses différentes approches d’enseignements, recommandations ainsi que pour leur contenu, mais également, pour les interprétations des rêves, qui seront communiqués et, d’autre part, tout éventuel dommages corporels, psychologiques ou maladies qui pourraient en résulter par les décisions et actions de l’ÉTUDIANT.
  • UCM se réserve le droit de modifier les termes et conditions du Service de ses formations à tout moment et sans préavis. L’ÉTUDIANT est invité à consulter régulièrement le présent document pour prendre connaissance des modifications éventuelles.
  • Les formations offertes par UCM proposent un approfondissement de soi par l’apprentissage du Langage Symbolique®, une méthode développée par UCM et permettant de comprendre les dynamiques inconscientes liées aux pensées, émotions et comportements.
  • Les formations de UCM sont un service payant. L’ÉTUDIANT peut effectuer son paiement via les modes de paiement proposés sur le site Web de UCM ou via les recommandations fournies par email à l’ÉTUDIANT.
  • Dans le cas de non-paiement d’une formation de UCM par l’ÉTUDIANT: UCM entreprend une communication avec les informations fournies par L’ÉTUDIANT, afin de clarifier sa situation. Sans réponse de l’ÉTUDIANT au bout de 1 mois jour pour jour après la première correspondance de clarification du non-paiement, l’accès de l’ÉTUDIANT à la formation sera mis en pause jusqu’à mise à jour du paiement en bonne et due forme.
  • UCM propose un remboursement seulement dans le cas où l’ÉTUDIANT, pour des raisons importantes et communiquées en bonne et due forme, doit arrêter une formation avant la fin de celle-ci. À ce moment-là, un montant de 25% est conservé par UCM, afin de couvrir les frais liés à la gestion du dossier de l’ÉTUDIANT et aux éventuels cours qu’il aurait reçu préalablement.
  • Tous les contenus et matériels proposés dans le cadre des formations de UCM, y compris les analyses de rêves et conseils associés, sont la propriété exclusive de UCM et sont protégés par les lois applicables en matière de propriété intellectuelle. UCM se réserve le droit sans préavis d’utiliser les données des rêves de façon éthique, confidentielle et anonyme pour améliorer l’offre de ses différents services dans l’interprétation des rêves signes et symboles. L’ÉTUDIANT ne peut pas reproduire, modifier ou distribuer ces contenus et matériels sans l’autorisation préalable de UCM.
